A joint alert from the American Bar Association (ABA) and the National Council of Juvenile and Family Court Judges (NCJFCJ) encourages earlier involvement of attorneys to help parents navigate child welfare investigations—before court cases are ever filed.
The report, “Supporting Early Legal Advocacy Before Court Involvement in Child Welfare Cases” (March 2021), outlines how early legal representation can help families stay together by addressing issues such as housing, medical care, and substance use treatment before they become reasons for removal.
Among the national examples highlighted is FIRST Legal Clinic in Washington State. The FIRST Clinic provides early, pre-court legal advocacy to prevent the unnecessary removal of infants from their parents. Working closely with hospitals, treatment providers, and parent allies, the clinic connects families to support and legal counsel as soon as CPS involvement becomes a concern.
According to the ABA and NCJFCJ, early legal advocacy:
