Early Legal Advocacy: A National Model for Keeping Families Together

Across the country, child welfare experts are rethinking when legal help should begin. A joint alert from the American Bar Association (ABA) and the National Council of Juvenile and Family Court Judges (NCJFCJ) encourages earlier involvement of attorneys to help parents navigate child welfare investigations—before court cases are ever filed.

The report, “Supporting Early Legal Advocacy Before Court Involvement in Child Welfare Cases” (March 2021), outlines how early legal representation can help families stay together by addressing issues such as housing, medical care, and substance use treatment before they become reasons for removal.

Among the national examples highlighted is FIRST Legal Clinic in Washington State. The FIRST Clinic provides early, pre-court legal advocacy to prevent the unnecessary removal of infants from their parents. Working closely with hospitals, treatment providers, and parent allies, the clinic connects families to support and legal counsel as soon as CPS involvement becomes a concern.

According to the ABA and NCJFCJ, early legal advocacy:

  • Helps keep families intact and reduces trauma caused by unnecessary separation.
  • Promotes positive outcomes for both parents and children.
  • Protects due process rights at the earliest stages.
  • Reduces racial disparities in child welfare.
  • Saves public resources by preventing court filings and foster care placements.

This national recognition underscores the growing understanding that timing matters—families need support and information before a crisis becomes a courtroom issue.
